The Lawyers’ Society of Sierra Leone has expressed support for the government’s national campaign against the drug epidemic, recognizing the serious threat drug abuse and trafficking pose to communities.
However, the Society emphasizes that all actions must strictly comply with constitutional guarantees and statutory frameworks. Recent concerns have arisen regarding the Practice Direction issued by the Chief Justice on 1st December 2025 on the handling of drug-related offences. The Society notes that:
- The Practice Direction lacks clear legal basis under the National Drug Control Act 2008.
- Mandating that all drug cases be concluded in the High Court contradicts provisions allowing summary trials.
- Bail restrictions and mandated sentences may conflict with statutory guidelines, undermining proportionality and judicial discretion.
The Society stresses that even individuals accused of serious offences are entitled to fair trial rights and due process. While supporting strong action against drug crimes, it urges that the fight against drugs be conducted through the rule of law, not in opposition to it.
The Lawyers’ Society calls on the Chief Justice to review and revise the Practice Direction to ensure compliance with existing legal frameworks and urges resources be allocated to expedite drug case adjudications. The Society remains committed to working with the judiciary, law enforcement, and other stakeholders to strengthen the rule of law in combating the drug epidemic.
