Court Restrains APC Executive Members, Allows Limited Support for District Elections

The High Court has restrained members of the All People’s Congress (APC) Executive from performing their functions as party executives, while allowing the National Chairman and Secretary-General to provide limited administrative support for the ongoing district-level elections.

The injunction bars the affected officials from holding themselves out as executive members, convening or attending executive meetings, participating in the affairs of the APC as executive members, or carrying out activities associated with the day-to-day running of the party.

However, the court has made specific exceptions to prevent the restrictions from disrupting the district-level elections.

Under the order, the National Chairman and Secretary-General may assist the election management bodies by signing approved payment cheques for polling staff and contractors and providing relevant information required for the conduct of the elections.

The court, however, clarified that the exemptions do not permit the affected officials to present themselves as National Chairman or Secretary-General or exercise the wider functions attached to those positions.

The order also restrains all APC executive members serving under the party’s 2022 Constitution from holding themselves out as executive members, convening or attending executive meetings, or performing functions associated with the party’s executive leadership, pending the hearing and determination of the application or further order of the court.

The court further ordered that actions taken on behalf of the APC, the third defendant, with effect from October 19, 2026, are restrained, except for matters specifically permitted under the order.

The court directed that the district-level elections be completed within 21 days, including the resolution of complaints arising from the elections.

It warned that disobedience of the injunction could amount to contempt of court, potentially resulting in fines or the seizure of assets.

The matter has been adjourned to Monday, October 19, 2026, in Court Six, for the conclusion of the matter.

The injunction remains in force pending the hearing and determination of the application or until further order of the court.
