Lawyers’ Society Members Seek Supreme Court Clarification on Passage of Constitutional Amendment Bill

The Lawyers’ Society says two of its members have filed an application before the Supreme Court seeking clarification on the constitutional requirements governing the passage of the Constitutional Amendment Bill 2025.

According to a press release dated Thursday, 3 September 2026, Thomas Moore Conteh, Esq. and Tamba Kellie, Esq. filed the application in their individual capacities.

The application, brought under Sections 124 and 127 of the 1991 Constitution, seeks the Supreme Court’s interpretation of the voting threshold and procedure required for the passage of constitutional amendment bills.

According to the Lawyers’ Society, the application follows what it describes as the “purported passage” of the Constitutional Amendment Bill 2025.

The Society says the legal action is not intended to challenge Parliament’s legislative authority, but rather to seek clarity on whether the constitutional requirements governing the amendment process were followed.

If the Court determines that the required procedure was not followed, the applicants are seeking a declaration that the purported passage of the Bill is null and void.

The Lawyers’ Society says it will continue to update its members and the public on the progress and outcome of the proceedings.
